This website is operated by Nuvellianessara Limited. By using the website, you agree to these Terms & Conditions to the extent applicable to your use. If you do not agree, you should stop using the site. Mandatory consumer rights that cannot legally be excluded or limited remain unaffected.
2. Permitted use of the website
You may use the site for lawful personal or business enquiries, reviewing product information, arranging tastings and placing orders where ordering functions are available. You must not interfere with site security, attempt unauthorised access, introduce malicious code, scrape the site in a way that imposes an unreasonable load, or use content in a misleading manner.
We may change, suspend or withdraw features where reasonably necessary for maintenance, security, legal compliance or service improvement.
3. Product descriptions and availability
Nut harvests are agricultural products and natural variation should be expected. Photographs illustrate presentation and general product type; colour, kernel size and exact mix may vary between batches. We aim to describe origin, roast, seasoning, pack weight and ingredients accurately, but small differences can occur when a harvest or supplier lot changes.
Products are subject to availability. A displayed product does not guarantee that stock remains available until an order is accepted. We may limit quantities where stock is scarce or where a listed quantity appears inconsistent with normal consumer purchasing.
4. Prices
Prices are presented in New Zealand dollars unless stated otherwise. Any delivery charge, applicable tax and other mandatory charge should be shown before a binding transaction is completed. If a clear pricing or description error is identified before acceptance, we may correct the error and give the customer the opportunity to confirm or cancel the affected order.
5. Orders and contract formation
Where online ordering is enabled, submitting a basket or checkout request is an offer to purchase. A binding contract is formed only when we accept the order through the relevant confirmation process. We may decline an order for legitimate reasons such as unavailable stock, payment failure, suspected fraud, delivery restrictions or an obvious error.
Customers are responsible for providing accurate delivery and contact information. If information is incomplete or incorrect, delivery may be delayed and additional reasonable costs may apply where permitted by law.
6. Delivery
Estimated dispatch and delivery windows are estimates unless expressly agreed as a guaranteed service. We are not responsible for delays caused by events reasonably outside our control, but we will provide information and appropriate remedies where consumer law requires them. Risk and title pass according to applicable law and the specific purchase arrangement.
7. Tasting bookings
Tasting availability depends on session capacity, staff availability and suitable sample stock. A requested date is not confirmed until we provide booking confirmation. Private sessions may require a minimum group charge or advance payment where stated at the time of booking.
If a customer needs to change or cancel a tasting, they should contact us as early as possible. Any cancellation terms provided with the booking confirmation form part of the booking contract. We may reschedule a session if unforeseen operational circumstances prevent the session from being delivered safely or to the expected standard.
8. Food information and allergens
Tree nuts are common allergens. Product labels and ingredient information should be checked before consumption, especially where a person has a known food allergy or sensitivity. Products may be packed in an environment where multiple nut varieties and seasonings are handled. If you require clarification about ingredients or cross-contact information, contact us before purchasing or consuming a product.
9. Returns, faults and consumer rights
Nothing in these terms excludes rights available under mandatory New Zealand consumer law. If goods are faulty, not as described or otherwise fail to meet a statutory guarantee, available remedies may include repair, replacement, refund or other relief depending on the circumstances and the law.
For change-of-mind requests involving food, acceptance may be restricted where packaging has been opened or where hygiene and product-integrity considerations make resale inappropriate. Any voluntary return policy operates in addition to, not instead of, mandatory consumer rights.
10. Intellectual property
Website text, branding, original graphics and layout are protected by applicable intellectual-property law. You may view and print reasonable extracts for personal use. You may not reproduce a substantial part of the site for commercial use, remove rights notices or present our branding as your own without permission.
11. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising solely from use of the website where such exclusion is lawful. We do not exclude liability that cannot legally be excluded, including liability arising from mandatory consumer guarantees or other non-excludable statutory duties.
12. Third-party and technical availability
The site may from time to time refer to information or services operated by third parties. We are not responsible for third-party content merely because a reference is provided. We do not guarantee uninterrupted website availability and may perform maintenance or security work when required.
13. Governing law and disputes
These terms are governed by the laws of New Zealand, subject to any mandatory rights a consumer may have under the laws that apply in their place of residence. The parties should first attempt to resolve a dispute by contacting each other in good faith. This clause does not prevent either party from using a court, tribunal or complaint mechanism available under applicable law.
